3. Export Terms

  • Product Availability: All products are subject to availability. If a product is unavailable, we will notify you and suggest alternative options.
  • Pricing: All prices listed on our website are in USD or as specified and do not include applicable taxes, duties, or shipping costs unless explicitly stated.
  • Order Confirmation: Once an order is placed, we will send an order confirmation to the email address provided. This confirmation signifies our receipt of the order and is not an acceptance of the order.
  • Shipping and Delivery: We ship internationally to the countries specified on our website. Delivery times and shipping charges depend on the destination and selected shipping method. Customers are responsible for customs duties, taxes, and fees imposed by the destination country.
  • Export Documentation: We will provide all necessary export documentation, including invoices, packing lists, and certificates of origin, in compliance with international trade regulations.

4. Payment

  • Payment Terms: Payment must be made upfront unless otherwise agreed in writing. Accepted payment methods include wire transfers and letters of credit (LC). All payments must be made in the agreed currency.
  • Currency: Payments will be processed in the currency stated at the time of order. Exchange rate fluctuations may impact final payment amounts.
  • Late Payment: In case of late payment, we reserve the right to charge interest on overdue amounts, as well as suspend or cancel the order until the payment is made in full.

5. Export Restrictions

  • Legal Compliance: The buyer is responsible for ensuring compliance with all applicable import/export laws, regulations, and restrictions in their home country. AFN EXPORTS will not be held liable for any violations of these laws.
  • Prohibited Items: AFN EXPORTS does not export prohibited items as defined by the Indian government and international trade regulations. The buyer is responsible for ensuring that the goods they order comply with their country’s import/export restrictions.

6. Risk and Title

  • Risk of Loss: Risk in the goods passes to the buyer upon shipment from our facility. We will not be held liable for any damages or losses during transit, unless covered by insurance.
  • Title Transfer: Ownership of the goods transfers to the buyer once full payment has been received by AFN EXPORTS, and all required documentation has been provided.

7. Returns and Refunds

  • Returns: As our products are intended for export, returns are generally not accepted unless the product is damaged during transit or does not meet the specifications agreed upon. If applicable, a return request must be submitted within 7 days of receiving the goods.
  • Refunds: Refunds will only be issued in cases where the product is defective or not as described. Refunds will be processed once the returned item is received and inspected.

8. Liability

AFN EXPORTS will not be liable for any indirect, incidental, or consequential damages arising out of the use of our products or services. Our liability will be limited to the total value of the goods purchased.

9. Force Majeure

AFN EXPORTS will not be responsible for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to acts of war, natural disasters, strikes, or government restrictions.

10. Dispute Resolution

Any disputes arising from or in connection with these Terms and Conditions will be resolved through binding arbitration in accordance with the laws of India. The venue for arbitration will be Saharanpur, Uttar Pradesh.

11. Amendments

AFN EXPORTS reserves the right to update or modify these Terms and Conditions at any time without prior notice. Any changes will be posted on this page and will be effective immediately upon posting.
